By using our webhosting services, you agree to comply with our policies. You are expected to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users. We expect you to have a basic knowledge of how the Internet functions, the types of uses which are generally acceptable, and the types of uses which are to be avoided. Common sense is the best guide as to what is considered acceptable use. The following are unacceptable uses:

Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, harassment, fraud, trafficking in obscene material, drug dealing, and other illegal activities.

Indemnification

You agree to indemnify, defend, and hold harmless Teeyes Web Solutions from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting indirectly from your use of the service which damages either you, Web Solutions, or any other party or parties without limitation or exception.

Refusal or discontinuance of service

Teeyes Web Solutions reserves the right to refuse or discontinue service to anyone at aalpha net's solution sole discretion. Teeyes Web Solutions may deny you access to all or part of the service without notice if you engage in any conduct or activities that Teeyes Web Solutions in its sole discretion believes violates any of the terms and conditions in this agreement.

Teeyes Web Solutions shall have no responsibility to notify any third-party providers of services, merchandise, or information, nor any responsibility for any consequences resulting from such discontinuance or lack of notification. you agree that Teeyes Web Solutions has the right to monitor the service electronically from time to time and to disclose any information as necessary to satisfy the law, or to protect itself or its subscribers. Teeyes Web Solutions reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this agreement.

Illegal Content

our hosting services may be used only for lawful purposes. transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. this includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes a legal threat, or violates export control laws. examples of unacceptable content or links: "pirated software", "hackers programs or archives", "warez sites", "irc bots", "mp3".

we will be the sole arbiters as to what constitutes a violation of this provision.

Spamming

Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is expressly prohibited. a user shall not use another site's mail server to relay mail without the express permission of the site or distributing, advertising or promoting software or services that have the primary purpose of encouraging or facilitating unsolicited commercial e-mail or spam.

it is contrary to aalpha net's solution policy for customers to use our servers to effect or participate in any of the following activities:

to post to any usenet or other newsgroup, forum, e-mail mailing list or other similar group or list articles which are off-topic according to the charter or other owner-published faq or description of the group or list;

to send unsolicited mass e-mailings, if such unsolicited e-mailings provoke complaints from the recipients;

to engage in any of the foregoing activities using the service of another provider, but channelling such activities through a aalpha net provided server, or using a aalpha net provided server as a maildrop for responses;

to falsify user information provided to Teeyes Web Solutions or to other users of the service in connection with use of a Teeyes Web Solutions service.

when Teeyes Web Solutions becomes aware of an alleged violation of its acceptable use policy, Teeyes Web Solutions will initiate an investigation (within 24-48 hours). during the investigation Teeyes Web Solutions may restrict customer 's access in order to prevent further possible unauthorized activity. if the customer is found in violation of our spam policy, Teeyes Web Solutions may, at its sole discretion, restrict, suspend, or terminate customer's account and/or pursue other civil remedies. also, Teeyes Web Solutions reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. if such violation is a criminal offense, Teeyes Web Solutions will notify the appropriate law enforcement department of such violation.

the customer shall be held liable for any and all costs incurred by Teeyes Web Solutions as a result of the customer's violation of these terms and conditions. this is including, but is not limited to, attorney fees and costs resulting from postmaster responses to complaints from and the cleanup of unsolicited commercial mailings and/or unauthorized bulk mailings and/or news server violations.

Age

the customer certifies that he or she is at least 18 years of age.

Privacy

Teeyes Web Solutions will make every effort to protect the privacy of aalpha net's solution clients. Teeyes Web Solutions will not reveal personal information regarding its clients. Teeyes Web Solutions cannot however protect privacy through the internic registration database as this information is open to the public.

Limitation of liability

Teeyes Web Solutions shall be the sole arbiter of what is and is not a violation of these acceptable use policies. Teeyes Web Solutions reserves the right to terminate an account at any time and for any reason that causes harm to any Teeyes Web Solutions customer's web sites. Teeyes Web Solutions reserves the right to delete all content and files upon termination. Teeyes Web Solutions reserves the right to withhold any pre-paid funds for any site removed for violations of these policies. Teeyes Web Solutions reserves the right to refuse, cancel, or suspend service at our sole discretion. Teeyes Web Solutions reserves the right to change the acceptable use policy without prior notice or warning. non-enforcement of any part of the acceptable use policy does not constitute consent.

client expressly agrees that use of aalpha net's solution server is at client's sole risk. neither Teeyes Web Solutions, its employees, affiliates, agents, third party information providers, merchants licensers or the like, warrant that aalpha net's solution server service will not be interrupted or error free; nor do they make any warranty as to the results that may be obtained from the use of the server service or as to the accuracy, reliability or content of any information service or merchandise contained in or provided through the Teeyes Web Solutions server service, unless otherwise expressly stated in this agreement.

Security

you agree that the security of your account is solely your own responsibility.

Backup of data

no guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. backups are made for server restoration purposes only. it is the clients' responsibility to maintain local copies of their web content any information. if loss of data occurs due to an error of Teeyes Web Solutions, Teeyes Web Solutions will attempt to recover the data for no charge to the client but does not guarantee its recovery. if data loss occurs due to negligence of client in securing their account or by an action of the client, Teeyes Web Solutions will attempt to recover the data from the most recent archive for a rs.5000/- fee.

Abuse of the legal rights of others

examples of unacceptable activities in this regard include posting private information about a person without their consent, infringing intellectual property rights, defaming a person or business, and knowingly making available code which will have a deleterious effect on third party computers. Teeyes Web Solutions supports free speech on the internet, and will not suspend or cancel a customer's account simply because it disagrees with the views expressed by the customer. where there are allegations that a customer's on-line activity has violated the legal rights of a third party, Teeyes Web Solutions will not substitute itself for a court of law in deciding tort claims raised by the third party.

Contract revisions

revisions to this contract will be applicable to previous contracts. revisions will be considered agreed to by the client on renewal of aalpha net's solution services.

Value added reselling

clients approved and authorized as Teeyes Web Solutions resellers are allowed to resell the storage and transfer services provided by Teeyes Web Solutions as provided for in its standard product offering. client agrees to handle and is responsible for all third-party client's content, support, set-up, maintenance and billing. client agrees to having the necessary additional knowledge and skill level required. client also agrees that they are responsible for all payments for accounts brought on by client under the reseller program.

Payments

all payments made to aalphanet are non-refundable.

Jurisdiction in case of disputes

in case of any disputes, the jurisdiction will be only at madurai courts. Teeyes Web Solutions reserves the right to change the acceptable use policy without prior notice or warning. non-enforcement of any part of the acceptable use policy does not constitute consent.

Modification

Teeyes Web Solutions reserves the right to add, delete, or modify any provision of this policy at any time without notice.
